Commission Decision of 11 November 2003 on establishing the European Regulators Group for Electricity and Gas
An independent advisory group on electricity and gas, called the ‘European Regulators Group for Electricity and Gas’ (hereinafter referred to as the ‘Group’), is hereby established by the Commission.
The Group, at its own initiative or at the request of the Commission, shall advise and assist the Commission in consolidating the internal energy market, in particular with respect to the preparation of draft implementing measures in the field of electricity and gas, and on any matters related to the internal market for gas and electricity. The Group shall facilitate consultation, coordination and cooperation of national regulatory authorities, contributing to a consistent application, in all Member States, of the provisions set out in Directive 2003/54/ EC, Directive 2003/55/EC and Regulation (EC) No 1228/2003, as well as of possible future Community legislation in the field of electricity and gas.

The new package of measures relating to the gas and electricity market require Member States to give responsibility for a number of decisions to designated “regulatory” or “competent” authorities. The most important of these authorities is the one described in Article 23 [25] of the electricity [gas] Directive, which will have responsibility for supervision of network access (“the regulatory authority”). These regulatory authorities are required to ensure non-discrimination, effective competition and the efficient functioning of the market.

This note aims to indicate what measures should be taken in the Member States in order to avoid PSOs distorting competition and slowing down the genuine opening-up of the market as provided for in Article 21 of the amended electricity Directive and Article 23 of the gas Directive.

In order to ensure non-discriminatory access to the network and avoid conflicts of interest it is necessary to separate the network business (natural monopoly) from those activities of a vertically integrated companies which compete on the market, namely production and supply.
Achieving this separation is the purpose of the unbundling provisions in the new electricity and gas directives, which are considerably strengthened in comparison to the previous directives.

The provision to specify the fuel mix and its related environmental impact obliges Member States to achieve a certain result and leaves to them the choice of form and methods. While a wide variety of options to implement this provision are open to Member States, it may be desirable to take into account the following suggestions, which are designed to help achieve the objective of transparency for consumers and to make comparisons between various suppliers possible.
