Α. Submission of Application
The procedure for issuing electricity Supply or Trading licenses follows:
- Law 4001/2011 (unofficial translation in english, screened by RAE, not valid for legal use) and
- the process described in Official Gazette B' 2940/05.11.2012 (unofficial translation in english, screened by RAE, not valid for legal use).
Article 134 (paragraphs 2 and 4) of L.4001/2011 differentiates the criteria that must be met for obtaining an Electricity Supply License. Additionally, according to article 13, licenses are issued, amended or revoked by decision of the Regulatory Authority for Energy (R.A.E).
The
application form for the issuance of a
supply license must be in accordance with annex 1 of article 19 of the
Official
Gazette B' 2940/05.11.2012.
The
application form for the issuance of a
trading license must be in accordance with annex 2 of article 19 of the
Official
Gazette B' 2940/05.11.2012.
The application form must be submitted in Greek language in written and electronic form (cd), although the supporting documents are accepted also in English.
The official processing of the application begins within 3 (three) months from the date:
- the application is complete, i.e. includes all the required documents under the Official Gazette B' 2940/05.11.2012
- the relevant application fees have been paid (i.e. the application includes a proof of deposit)
- a summary of the application has been published by RAE in its website for 15 days (article 6 of the Official Gazette B' 2940/05.11.2012)
A.1. Conditions for the provision of a Supply License
The Applicant must:
- be SA or Ltd with registered share capital of at least € 600.000.
- have an organizational and administrative structure adequate to ensure reliable, credible, prudent and sound business of Supply.
- has the necessary financial strength and creditworthiness, as evidenced by the accompanied financial statements and business plan.
- The holder must, in exercising its activities, provide sufficient long-term guarantees to ensure availability of capacity for injection at the Hellenic Transmission System of Electricity (currently operated by H.T.S.O SA) in accordance with the provisions of the Power Exchange and Grid Code
A.2. Application Fees
- In case of a new license, the fee is set at 29,36 € per MW.
- In case of modification of the existing license conditions, the fee is set at 5,86 € per MW of the initial license.
- In case of modification due to capacity increase (MW), the fee is set at 5,86 € per MW of the initial license plus 29,36 € for each additional MW.
Α.3. Publication of the Application
Within 15 days from the submission of the application form for a supply or a trading license, RAE publishes on its website a summary of the content of the application which includes at least the following:
- the name of the entity
- the type of the license (supply or trading)
- any other information or data that the Authority considers necessary to publish.
B. Relevant laws & regulations regarding licenses

C. Indicative List of Required Documents
- Supply license application form
The relevant application form must be submitted in Greek language in written and electronic form (CD), although the supporting documents are acceptable also in English
- Three (3) separate Solemn Declarations signed by the applicant or by the authorized representative.
- If the attached Greek form of the solemn declaration of Law 1599/1986 is used, it should have proof of authenticity by Greek Public Authorities.
- If the attached English form of the solemn declaration of Law 1599/1986 is used, it should have proof of authenticity by Greek Embassy or Consulate.
- otherwise, 3 separate Solemn Declarations of the country of origin duly authorized and apostilled are required.
- after granting the license should comply with the terms and conditions of
- article 134 of Law 4001/2011 (Declaration Sample1_en) and
- article 141 of Law 4001/2011 (Declaration Sample2_en)
- all the information enclosed in the application folder is true (Declaration Sample3_en) and
- the legal entity has fulfilled all its obligations and debts to the relevant Operators in the Greek electricity market. (Declaration Sample3_en)
- Proof of deposit of the prescribed fee.
- Copies of the applicant’s legal documents which demonstrate: the company’s legally authorized form (e.g. S.A. or Ltd), the legal representation of the company, the paid up share capital and the ownership of the shares (ownership tree starting from individuals).
- Certificate of the organizational and administrative structure of the applicant company mentioning its partners and managers in other companies or groups of companies at home and abroad.
- Financial Statements of the Company for the last three (3) financial years accompanied with the corresponding reports of auditors and associated certificates. If the applicant has no financial statements, the relative financial statements of its main shareholders are required.
- Summary of a Business Plan of the applicant company for the next five (5) years. (Please mention that this is required only for the issuance of a supply license).
